Governor Moore Signs Executive Order Delaying Advance Clean Trucks Rule.

Passed in 2023, the Advance Clean Trucks Rule (ACT) is a mandate on truck manufacturers that they sell increasing percentages of zero emission trucks or face potential fines and penalties. Maryland was slated to kickoff the ACT with Model Year 2027 vehicles; however, thanks to a robust effort from MMTA and the MD Auto Dealers Association, that mandate is now delayed until at least Model Year 2028 and potentially Model Year 2029. Since January, MMTA and MADA have repeatedly met with House and Senate leadership and the Governor’s office to express concerns about both Advance Clean Trucks and Advance Clean Cars 2.
Legislation was moving towards passage in the MD General Assembly, but ultimately Governor Moore signed an Executive Order mandating the following for Advance Clean Trucks.
- When the ACT originally passed in 2023, MMTA had language inserted requiring that the state must complete a robust needs assessment of grid capacity, product cost and availability, battery range, charging infrastructure, etc. That study was required to be done by December 1, 2024 but was not started until January 2025.
- Therefore, the Governor’s EO affirms that no penalties may be enforced against the manufacturers for failure to meet the required Model Year 27 sales percentages – essentially delaying the program until at least Model Year 2028 since the state failed to complete the assessment within the mandated timeframe.
- If the state does not complete the needs assessment by December 1, 2025, the ACT is further delayed until at least Model Year 2029.
- Based on the assessment findings, further delays are authorized if the state is not prepared for implementation.
- A workgroup is formed that will include MMTA and MADA to develop recommendations on how ACT and ACC can be successfully implemented in MD.
